ASCENDANCE AI — PRIVACY POLICY

Effective Date: July 27, 2026

This Privacy Policy describes how Ascendance AI ("Ascendance," "we," "us," or "our") collects, uses, stores, and deletes information in connection with the AI-powered lead capture and appointment-booking service (the "Service") provided to brokerages and businesses ("Client") and the individuals who interact with the Service ("Leads" or "you").

1. Information We Collect

  • Lead contact information: name, phone number, email address, and messages submitted through the chatbot.
  • Inquiry details: property interests, budget range, timeline, financing status, or other information a Lead voluntarily shares during a conversation.
  • Conversation logs: the full text of chatbot interactions and timestamps.
  • Client account information: business name, contact details, and billing information used to configure the Service.
  • Technical data: limited metadata such as IP address or device/browser type where the chatbot widget is embedded on a website.

2. How Lead Data Flows

When a Lead interacts with the chatbot widget on Client's website, the conversation is processed to generate a response and qualify the inquiry. The resulting lead record and conversation summary are logged to a Google Sheet owned and controlled by Client, to which Client has sole and exclusive access. Ascendance also sends Client an email notification each time the chatbot captures a new lead or conversation, so that Ascendance's systems briefly process and transmit that conversation data as part of routine Service delivery, in addition to the copy stored in Client's own spreadsheet. The chatbot does not itself conduct ongoing automated follow-up with the Lead after the initial conversation; follow-up with the Lead is performed by Client.

To generate its responses, the chatbot submits conversation text to a third-party AI model provider (such as Anthropic's Claude or OpenAI) for processing. That provider's model generates the chatbot's reply. Ascendance's own systems also process conversation content in order to generate the email notification sent to Client, as described in Section 2 above. Ascendance does not sell conversation content, does not use it to train models for other clients, and will not disclose it to any unauthorized third party. Ascendance does not manually review or monitor conversations as a matter of routine business practice. Ascendance does not control, and cannot make representations or guarantees about, how the third-party AI provider handles, retains, logs, or otherwise uses data submitted to it for processing, beyond what is stated in that provider's own terms and policies.

3. How We Use Information

  • To operate the chatbot conversation and qualify leads on Client's behalf.
  • To log lead and conversation data to the Google Sheet designated by Client, and to notify Client by email when a new lead or conversation is captured.
  • To provide customer support, troubleshoot the Service, and improve chatbot conversation quality.
  • To send Client account communications, invoices, and service updates.
  • To comply with legal obligations and enforce our Terms of Service.

4. How Information Is Shared

We do not sell Lead or Client personal information. We share information only as follows:

  • With Client: all lead and conversation data collected through the Service is shared with the Client for whom the Lead submitted an inquiry, since Client is the intended recipient of that lead.
  • With service providers: limited data is shared with third-party providers that support the Service, such as payment processing (e.g., Stripe), e-signature (e.g., DocuSign), and cloud hosting/email delivery, solely to the extent necessary to provide the Service.
  • With the AI model provider: conversation text is shared with a third-party AI model provider (such as Anthropic's Claude or OpenAI) solely to generate the chatbot's responses. Ascendance is not responsible for that provider's own data handling, retention, or security practices.
  • For legal reasons: where required to comply with law, respond to lawful requests, or protect the rights, safety, or property of Ascendance, Client, or others.
  • Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to standard confidentiality protections.

5. Client Data Ownership and Restricted Use

Client owns its lead and conversation data. Ascendance's use of that data is limited to delivering the Service to that specific Client. Ascendance does not: sell Client or Lead data; use one Client's lead or conversation data to train, improve, or fine-tune models or features for the benefit of other clients; share a Client's leads or conversation data with other brokerages, competitors, or unrelated third parties; or repurpose Client data for Ascendance's own marketing without Client's express written consent. Upon termination, Ascendance will delete or return Client's data as described in Section 7 below, rather than retain it for unrelated use.

6. Data Security

Ascendance uses commercially reasonable administrative, technical, and physical safeguards designed to protect information against unauthorized access, use, or disclosure. No method of transmission or storage is completely secure, and Ascendance cannot guarantee absolute security.

7. Data Retention and Deletion Policy

Ascendance retains Lead and Client data for as long as reasonably necessary to provide the Service and for legitimate business purposes, such as maintaining accurate records, complying with legal obligations, and resolving disputes.

  • Upon termination of a Client's Service Agreement, Ascendance will delete or de-identify that Client's lead data, conversation logs, and account information within thirty (30) days, except where retention is legally required.
  • A Lead or Client may request deletion of specific personal information by submitting a written request to the contact address below; Ascendance will process verified deletion requests within a reasonable time and confirm completion in writing.
  • Backup copies may persist for a limited period in encrypted backup systems before being purged through routine backup-cycle deletion.

8. Your Choices and Rights

Depending on your state of residence, you may have rights to access, correct, or request deletion of your personal information, and to opt out of certain uses. To exercise these rights, contact us using the information below. We will verify the request before taking action and may need to retain limited information to fulfill legal or contractual obligations.

California Privacy Rights (CCPA/CPRA): If you are a California resident, you have the right to: (1) know what personal information Ascendance has collected about you and how it has been used and shared; (2) delete personal information Ascendance has collected from you, subject to certain exceptions; (3) correct inaccurate personal information; and (4) opt out of the sale or sharing of your personal information. Ascendance does not sell or share personal information for cross-context behavioral advertising. To exercise any of these rights, contact Ascendance at the email address in Section 13 below. Ascendance will verify your request before acting on it and will not discriminate against you for exercising these rights.

9. No Cookies or Website Tracking

The chatbot is delivered as a website chat widget only. Ascendance does not use cookies, tracking pixels, or similar website-tracking technologies in connection with the chatbot widget.

10. Children's Privacy

The Service is intended for business use by adults and is not directed to individuals under the age of 18. Ascendance does not knowingly collect personal information from children.

11. Changes to This Privacy Policy

Ascendance may update this Privacy Policy from time to time. Material changes will be posted with an updated effective date, and where required by law, additional notice will be provided.

12. Governing Law

This Privacy Policy is governed by the laws of the State of Connecticut, without regard to conflict-of-laws principles, consistent with the governing law provision in the Ascendance AI Terms of Service.
